By proceeding with your booking and participating in any watersports activities provided by TideTales Watersports Inc., you acknowledge and agree to the terms outlined in this waiver. Your acceptance of these terms serves as a full release of liability for TideTales Watersports Inc. and its representatives.

Statement of Risks

At TideTales Watersports Inc., your health, safety, and enjoyment are our top priorities. While we take reasonable steps to ensure all equipment is safe and our team is well-trained, certain risks are inherent to water sports activities. These risks may include, but are not limited to:

• Drowning due to changing water flow, tides, or wave action.
• Injuries from equipment, collisions, capsizing, or falling on wet surfaces.
• Collisions with other participants or watercraft.
• Other unforeseen dangers associated with watersports activities.

By agreeing to this waiver, you acknowledge these risks and voluntarily choose to participate, relinquishing any claims against TideTales Watersports Inc.

Acknowledgement & Assumption of Risks

By participating in any watersports activities with TideTales Watersports Inc., you confirm that you:

• Understand that these activities involve risks, including personal injury or, in extreme cases, permanent disability or death.
• Accept full responsibility for your participation and release TideTales Watersports Inc. from any claims or liability arising from these risks.

Medical Fitness Confirmation

By agreeing to this waiver, you certify that you are medically fit to participate in watersports activities. If you have any health concerns, you acknowledge that it is your responsibility to consult a physician before participating.

Indemnity Agreement

By participating, you agree to indemnify and hold harmless TideTales Watersports Inc. from any claims, demands, or liabilities (including legal fees) arising from your involvement in these activities, except in cases of gross negligence or intentional misconduct by TideTales Watersports Inc.

Photography and Media Release

By participating in our activities, you grant TideTales Watersports Inc. permission to capture and use photos/videos for promotional and marketing purposes.

Waiver for Minor Participants

If you are signing on behalf of a minor child, you confirm that you:

• Are the legal guardian of the minor child.
• Understand and accept the risks on behalf of the child.
• Release TideTales Watersports Inc. from any liability related to the child’s participation in watersports activities.

Acceptance of Terms

By proceeding with your booking and checking the box below, you confirm that you have read and understand this waiver, and you agree to release TideTales Watersports Inc. from any liability.
